Following four heating-oil overflows, the administrative court allocated the costs of the security measures among the entities involved in the pollution: the heating-oil supplier, the tank constructor and the tank inspector. The court held that, in case of violations of water-protection and environmental rules caused by a spill capable of affecting waters, the authority must determine ex officio the respective share of responsibility of each polluter. Résumé

En cas de violation de la LFEAUX et de la LFPE par un débordement de liquide pouvant altérer les eaux, il appartient à l'autorité de rechercher d'office quelle est la part de responsabilité de chaque perturbateur, lequel n'est tenu de rembourser le coût des mesures de sécurité que dans la proportion de la responsabilité qui lui serait imputée selon les art. 50 al. 2 et 51 al. 2 CO, dans le cadre de ses relations internes avec ses coobligés. L'autorité s'adressera d'abord au perturbateur par comportement et en second lieu au perturbateur par situation. En l'espèce, le TA a réparti les frais liés aux mesures de sécurité prises à la suite de 4 débordements de mazout et les a répartis entre les différents perturbateurs, soit la société qui a livré le mazout, le constructeur de citernes et le réviseur de citernes.
