Omnilex-Zusammenfassung

The applicants challenged the City of Geneva’s refusal to authorize two advertising posters on a private building. The court held that Art. 56(3) LR governs only the public domain and cannot be used to regulate advertising on private property merely because it is visible from public space. It further held that the general implementing regulation of the LPMNS does not apply to buildings that are not protected sites. Because the refusal restricted property rights without a clear legal basis, the city could not lawfully deny the authorization.

Omnilex-Regeste

Art. 56 al. 3 LR; advertising on private property visible from the public domain; requirement of a clear legal basis for restrictions on ownership. The provision concerning advertising on the public domain is not applicable to installations placed on private immovable property, even if they can be seen from public space. A general implementing regulation of heritage protection likewise cannot be extended to buildings that are not sites within its scope. The prohibition of a signboard on private land constitutes a restriction of ownership and therefore requires a sufficiently clear statutory basis; absent such basis, the refusal of authorization is unlawful (consid.

Kernrechtsfrage

Whether Art. 56(3) LR allows the municipality to regulate or prohibit advertising displayed on private property but visible from public space.

Extrahierter Entscheid

No. The provision is limited to the public domain and cannot be used to control advertising on private property, even if visible from the public domain.

Extrahierte Begründung

The court held that Art. 56(3) LR was never intended to regulate advertising on private land. Extending it to private property would lack a clear legal basis.

Kernrechtsfrage

Whether the general implementing regulation of the LPMNS applies to buildings that are not protected sites.

Extrahierter Entscheid

No. The regulation does not apply to buildings that do not constitute sites within the meaning of that framework.

Extrahierte Begründung

The court found that the implementing regulation could not be invoked for immovable property outside the category of protected sites.

Kernrechtsfrage

Whether the refusal to authorize the posters unlawfully restricted property rights without a clear legal basis.

Extrahierter Entscheid

Yes. Prohibiting the installation of an advertising panel on a building restricts constitutionally protected property rights and requires a clear statutory basis, which was lacking.

Extrahierte Begründung

A restriction of the right of ownership under Art. 22 ter Cst. fed. cannot be upheld in the absence of an explicit legal foundation.
