Résumé

Le TA a admis le recours contre le refus d'installer une terrasse, dans la mesure où la mesure ne permet pas d'atteindre le but visé. En effet, les plaintes des habitants de l'immeuble ont trait essentiellement au bruit provenant du salon de jeux situé à l'intérieur du bâtiment, et non de la terrasse. Par ailleurs, le rapport émanant de la gendarmerie est favorable à l'installation de la terrasse et n'indique pas que l'usage de cette dernière aurait perturbé la tranquillité publique des habitants de l'immeuble.
