Omnilex-Zusammenfassung

The administrative court upheld a disciplinary decision by the bar commission against an attorney. The attorney had repeatedly filed reckless appeals and had failed to disclose a settlement agreement in a recourse to the Federal Supreme Court, thereby acting with inadmissible levity and contrary to professional duties. The court rejected challenges based on legality, ne bis in idem, and proportionality. It confirmed a two-month suspension from practice and a CHF 3,000 fine.

Omnilex-Regeste

Art. 49 LPAV; disciplinary sanctioning of breaches of professional duties; legality principle and ne bis in idem. The statutory formula 'any breach of professional duties' is sufficiently definite to meet the requirement of legality for disciplinary proceedings. A disciplinary sanction imposed by the bar authority is not precluded by a prior disciplinary fine of the Federal Supreme Court under Art. 30 para. 2 OJ. Repeated frivolous remedies and the failure to disclose a settlement agreement affecting standing to appeal constitute conduct incompatible with an attorney's duties and may justify a suspension and fine; proportionality is assessed in light of the gravity and repetition of the misconduct.

Whether Art. 49 LPAV is sufficiently specific under the legality principle to punish breaches of professional duties.

Extrahierter Entscheid

Yes. The wording 'any breach of professional duties' is sufficiently precise to cover sanctionable conduct.

Extrahierte Begründung

The court held that the statutory formula defines the punishable conduct with adequate clarity for disciplinary enforcement.

Kernrechtsfrage

Whether the disciplinary sanction violated ne bis in idem because the Federal Supreme Court had already imposed a disciplinary fine under Art. 30 para. 2 OJ.

Extrahierter Entscheid

No. The later disciplinary sanction does not breach ne bis in idem.

Extrahierte Begründung

The court considered the Federal Supreme Court fine and the bar disciplinary sanction as not excluding each other in the relevant sense.

Kernrechtsfrage

Whether the two-month suspension and CHF 3,000 fine were proportionate.

Extrahierter Entscheid

Yes. The sanction was proportionate given the repeated filing of reckless appeals and the attorney's omissions.

Extrahierte Begründung

Repeated frivolous recourse to the Federal Supreme Court and the omission of an existing settlement agreement justified the disciplinary response.
