ATA/802/1997Cour de justice / Verwaltungskammer23.12.1997

Omnilex-Zusammenfassung

The dispute concerned accident-insurance benefits for a person in training. The decision states that the relevant income for disability benefits is the income actually earned before the accident, and that a pension cannot be calculated on the wage the insured would have earned only after completing training, even if that amount corresponds to the usual profession-related salary. The case also recognizes an impairment compensation of CHF 20,400 for a moderate painful spinal syndrome together with pulmonary and thoracic pain-related impairment.

Art. 24 OLAA; calculation of accident-insurance disability benefits for persons in training and assessment of impairment compensation. For insured persons still in training, the full salary is determined by the remuneration expected upon completion of the training, but the invalidity income for pension purposes remains tied to the pre-accident earning basis actually realized; a hypothetical post-training professional wage cannot be substituted if it was not yet earned. An impairment compensation is awarded where the bodily sequelae produce a compensable permanent anatomical or functional detriment, the amount depending on the medically established degree of impairment (consid. not specified).

Kernrechtsfrage

Whether the insured person's pre-accident earnings or expected post-training salary should be used to calculate disability benefits for a trainee.

Extrahierter Entscheid

The earning capacity basis is the wage actually achieved before the accident; for a person in training, the full salary is the one expected at the end of the training, but the disability pension may not be calculated on the hypothetical wage of the learned profession if the insured did not yet earn it.

Extrahierte Begründung

The decision follows the principle that the pre-accident earned income serves as the basis for daily benefits and disability pensions. Even if the insured did not yet earn the usual wage in the profession, the pension base cannot be set on the income that would have been earned only after completion of the training.

Kernrechtsfrage

Whether impairment compensation was due for the documented spinal pain syndrome and pulmonary/thoracic complaints, and in what amount.

Extrahierter Entscheid

Impairment compensation was awarded in the amount of CHF 20,400 for a moderate painful vertebral syndrome together with pulmonary and thoraco-algic impairment.

Extrahierte Begründung

The medical consequences described justified a compensable permanent impairment within the accident insurance scheme.
