2. Alle Parteien vertreten die Auffassung, dass auf das

Quartierplanverfahren das kommunaleRecht anwendbar sei. Ent- gegen dieser Ansicht ist indessen das Quartierplanverfahren aus- schliesslichnach den einschlägigen Bestimmungendes neuenKRG mit der dazugehörigen KRVOabzuwickeln. Art.107 Abs. 2 Ziff. 1 KRG erklärt nämlich die Bestimmungen über Verfahren und Zuständigkeitnach Art. 5 zum unmittelbar anwendbaren Recht. Art. 5 Abs. 1 KRG sieht wiederumvor, dass für die in diesem Ge- setz und in der Verordnung festgelegten Verfahren für Planungen, Bauvorhaben, Landumlegungen und die Erhebung vonErschlies- sungsabgaben ausschliesslich kantonalesRecht gilt, soweit die Gemeinden und Regionalverbände nicht ausdrücklich ermächtigt oder verpflichtet werden, abweichende oder ergänzende eigene Verfahrensvorschriften zu erlassen oder bestimmte Verfahren selbst zu regeln. Für das Quartierplanverfahren sind solche Aus- nahmen im vorliegend interessierenden Zusammenhang nicht vorgesehen. Das hat zur Folge, dass für die Einleitung einesQuar- tierplanverfahrens ausschliesslich auf das KRG abzustellen ist. Diesbezüglich bestimmt Art. 53 Abs. 2 KRG, dass der Gemeinde- vorstand von Amtes wegen oder auf Antrag Privater über die Ein- leitung der Quartierplanung beschliesst. Lehnt er private Anträge ab, teilt er dies den Antragstellenden in einer anfechtbarenVerfü- gung mit.Nach dieserVorschrift kann somit selbst ein einzelner Interessent an den Gemeindevorstand gelangen, um diesen zur Prüfung, ob die Voraussetzungen für die Einleitung einesQuartier- planverfahrens gegeben sind zu veranlassen. Umgekehrt verleiht dieVorschrift dagegenselbst einerqualifizierten Mehrheit**der

Grundeigentümer im betroffenen Gebiet keinen Anspruch auf Ein- leitung eines Verfahrens, sondern eben auch nur auf die Prüfung der Frage, ob eine Quartierplanung einzuleiten ist. Im Ergebnis ist die Baubehörde entsprechend der Bestimmung des KRG vorge- gangen und hat geprüft, ob sich vorliegend die Verfahrenseinlei- tung rechtfertigt. Ob sie dies zu Recht verneint hat, ist im Folgen- den zu beurteilen.
