The IV procedure normally requires a pre-decision notice and opportunity to object. Since the office did neither, there was a hearing violation under Art. 29(2) BV. However, the violation was not so severe as to require remittal, because the appellate court could fully review facts and law and a remittal would create a pointless procedural loop.
