Dies stelle eine Verletzung des rechtlichen Gehörs dar, und die beanstandete Verfügung sei schon aus formellen Gründen aufzuheben. Der Untersuchungsrichter hätte ihn über den Gang der Ermittlungen informieren müssen. Festzuhalten ist zunächst, dass der Untersuchungsrichter ein Ermittlungsverfahren einstellen kann, ohne den Parteien zuvor Gelegenheit zu Stellungnahme geben zu müssen. Der Verletzte hat zwar das Recht auf Akteneinsicht (§ 84 Abs. 1 StPO) und kann auch Untersuchungshandlungen beantragen (§ 14 StPO), aus der StPO kann jedoch weder ein Anspruch auf Information über den Gang des Verfahrens noch auf Anhörung vor einer allfälligen Einstellung abgeleitet werden. Die Rechte des Strafanzeigers bzw. -antragstellers sind in diesem Stadium dadurch gewahrt, dass ihm Einstellungsentscheide mit einer kurzen schriftlichen Begründung zu eröffnen sind und mit Beschwerde angefochten werden können (§ 85 StPO).
