Omnilex-Zusammenfassung

The appellant in a divorce provisional-measures case withdrew her appeal after the respondent voluntarily supplied income information. The Court of Appeal treated the withdrawal as desistance and struck the case from the docket. Although withdrawal normally implies the withdrawing party’s defeat, the chamber exceptionally waived both court fees and party compensation because the appeal had not yet been served on the respondent, who therefore incurred no costs, and the withdrawal likely stemmed from a misunderstanding of prior case law.

Omnilex-Regeste

Art. 352 cpv. 1 CPC; withdrawal of an appeal and costs. The withdrawal of an appeal is equivalent to desistance and ordinarily leads to the withdrawing party being treated as unsuccessful. Exceptionally, however, the appellate court may waive court fees and party compensation where the appeal was withdrawn before service on the respondent and the latter therefore incurred no expenses. Such waiver rests on the concrete circumstances of the case and does not alter the general rule that desistance entails loss for the withdrawing party.

sedente per statuire nella causa__..____ (azione di divorzio: misure provvisionali) della Pretura del Distretto di Lugano, sezione 6, promossa con istanza del 10 novembre 1999 da

Contro

__________, __________ (patrocinato dall'avv. __________, __________);

premesso che il 25 novembre 1999 __________ ha introdotto appello contro un decreto cautelare emanato dal Pretore l'11 novembre 1999;

preso atto che il 2 dicembre 1999 essa ha dichiarato di ritirare l'appello, il convenuto avendo accettato spontaneamente, nel frattempo, di dare informazioni sui propri redditi;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375), sicché l'interessata andrebbe considerata soccombente;

osservato nondimeno che l'appellante sembra avere ricorso per avere frainteso la portata della sentenza apparsa in Rep. 1997 pag. 121;

accertato inoltre che al momento del ritiro l'appello non era ancora stato intimato al convenuto, il quale non ha quindi dovuto affrontare spese;

ritenuto che nelle circostanze descritte si giustifica – eccezionalmente – di rinunciare tanto al prelievo di oneri processuali quanto all'attribuzione di ripetibili;

richiamato l'art. 352 cpv. 1 CPC,

decreta: 1. La causa è stralciata dai ruoli per desistenza.

  1. Non si riscuotono tasse o spese né si assegnano ripetibili.

  2. Intimazione:

Kernrechtsfrage

Whether court fees and party costs should be charged despite the withdrawal.

Extrahierter Entscheid

Exceptionally, no court fees, expenses, or party compensation were awarded.

Extrahierte Begründung

Although withdrawal normally makes the withdrawing party the losing party, the chamber exceptionally waived both court fees and any award of ripetibili because the respondent had not yet been notified and thus had incurred no costs, and the appellant likely withdrew due to a misunderstanding of prior case law.
