ed ora sullo scritto 8 ottobre 2001 con cui il convenuto chiede al primo giudice di rivedere la sua decisione, che ritiene infondata, senza addebitargli ulteriori spese;
preso atto che l'appellante, con lettera 15 ottobre 2001, ha comunicato di voler ritirare l'impugnativa, che in realtà altro non era che uno scritto con cui egli esponeva le sue osservazioni in merito alla decisione pretorile;
decreta: 1. La procedura d'appello 12.2001.00172 è stralciata dai ruoli.
Non si prelevano né tasse, né spese, né si assegnano ripetibili.
