nella quale procedura il Pretore, con decisione 19 gennaio 2006, ha parzialmente accolto la domanda processuale 2 settembre / 25 novembre 2005 dei convenuti, ordinando la traduzione del doc. P, ma non del doc. L;

appellanti i convenuti che, con atto di appello 25 gennaio 2006, al quale il primo giudice ha concesso l’effetto sospensivo, chiedono la riforma del primo giudizio nel senso di accogliere integralmente la loro domanda di traduzione dei documenti;

ritenuto

in fatto e in diritto:

che la decisione qui impugnata con cui il Pretore si è espresso in merito alla traduzione o meno, ex art. 203 cpv. 1 CPC, di alcuni documenti (in lingua tedesca) versati agli atti dall’attore costituisce -come del resto indicato dal giudice stesso- un'ordinanza, tanto è vero che tratta una questione che concerne l'istruttoria della causa (Cocchi/Trezzini, CPC-TI, ad art. 94 m. 2);

che un’ordinanza non è appellabile (art. 95 cpv. 1 CPC);

che la palese improponibilità dell'appello presentato dai convenuti può così essere sanzionata già all'esame preliminare dell'art. 313bis CPC senza necessità di doverlo intimare alla controparte per le osservazioni;

che gli oneri processuali di questo giudizio seguono la soccombenza degli appellanti (art. 148 CPC);

Per i quali motivi

visti, per le spese, gli art. 147 segg. CPC e la vigente TG

pronuncia

  1. L'appello 25 gennaio 2006 di AP 1 e AP 2 è inammissibile.

  2. La tassa di giudizio di fr. 150.- e le spese di fr. 50.- (totale fr. 200.-) sono a carico degli appellanti in solido.
