tendente ad ottenere il rigetto provvisorio dell'opposizione interposta al PE n. __________ del 4/8 giugno 1999 dell'UE di Lugano;
sulla quale istanza la Pretore del Distretto di Lugano, Sezione 5, con sentenza 26 luglio 1999 ha così deciso:
"1. L'istanza è accolta e di conseguenza l'opposizione interposta al summenzionato precetto esecutivo è respinta in via definitiva.
Sentenza dedotta tempestivamente in appello dall'escussa che con atto 6 agosto 1999 ha chiesto in via principale la reiezione dell'istanza ed in via subordinata la sospensione della procedura, con protesta di spese e ripetibili;
con osservazioni 9 settembre 1999 la parte appellata si è opposta al gravame, protestate spese e ripetibili;
preso atto che scritto 14 gennaio 2000 l'appellante ha comunicato il ritiro dell'esecuzione in esame da parte della procedente, chiedendo lo stralcio dai ruoli della procedura d'appello con spese a suo carico e, con il consenso della parte appellata, che le ripetibili vengano compensate;
ritenuto come la procedura d'appello va quindi stralciata dai ruoli
pronuncia
L'appello 6 agosto 1999 __________ è stralciato dai ruoli nel senso dei considerandi.
