A supervisory complaint in a bankruptcy enforcement matter challenged auction conditions for a parcel sale. The court had previously granted suspensive effect. On 24 May 1995 the complainant withdrew the complaint, rendering the proceeding without object. The Camera di esecuzione e fallimenti therefore struck the complaint from the docket and ordered that no costs or indemnities be charged.
Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; withdrawal of a supervisory complaint in debt-enforcement proceedings renders the matter devoid of object and justifies striking it from the docket. Where the appellant withdraws the complaint, the supervisory authority does not decide the merits, but merely takes note of the withdrawal and terminates the proceeding. In the absence of a merits decision, no costs and no indemnity are awarded, unless special circumstances justify otherwise (consid. 1-2).
