The complainant filed a supervisory complaint against an enforcement attachment act issued by the Lugano debt enforcement office. After observations had been filed and the file completed, the complainant withdrew the complaint. The cantonal appeal chamber held that the proceeding had become moot and struck the matter from the docket. It also ordered that no court costs be taken and no compensation be granted.
Art. 61 cpv. 2 lett. a and 62 cpv. 2 OTLEF; withdrawal of a supervisory complaint in debt-enforcement proceedings renders the case devoid of object and justifies striking it from the docket. In such circumstances, absent a substantive determination, no costs or indemnity need be awarded.
