statuendo sul ricorso 21 febbraio 2002 di


contro

l’operato dell’Ufficio di esecuzione e fallimenti di Locarno, e meglio contro la comminatoria di fallimento emessa il 7 febbraio 2002 nell’esecuzione n. __________;

richiamato che per l’art. 9 cpv. 2 LPR l’Autorità cantonale di vigilanza, ricevuto un ricorso, può determinarsi sullo stesso senza ulteriori atti istruttori se il gravame è infondato o temerario, atteso che nel caso di reiezione del gravame non può darsi pregiudizio alcuno a carico di chi non è stato sentito (cfr. Cometta, op.cit., n. 2.2.2. ad art. 9; CEF 5 settembre 2001 [15.2001.252]);

considerato che la comminatoria di fallimento impugnata è stata emanata in base alla sentenza 6 dicembre 2001 del Pretore di Locarno-Città (inc. OA.1999.49), e meglio al suo dispositivo n. 1.2 che recita: “È rigettata in via definitiva l’opposizione interposta da __________ al precetto esecutivo n. __________ dell’UEF di Locarno”;

atteso che tale dispositivo è passato in giudicato (unitamente ai dispositivi n. 1.1 e 1.3 della stessa sentenza), come attestato dalla Pretura di Locarno-Città;

considerato per contro ininfluente che il rimanente dispositivo n. 2 relativo all'azione riconvenzionale non sia ancora passato in giudicato a dipendenza dell'appello richiamato nel ricorso;

ritenuto come il gravame sia quindi manifestamente infondato;

ricordato che – benché la gratuità della procedura sia contraria al sistema di diritto amministrativo in cui si muove il ricorso secondo l'art. 17 LEF (Jean–François Poudret/Suzette Sandoz–Monod, Commentaire de la loi fédérale d'organisation judiciaire, vol. II, Berna 1990, n. 2.10 all'art. 81, p. 804) – siffatto principio è stato codificato per espressa volontà del legislatore (art. 20a cpv. 1 primo periodo LEF e 61 cpv. 2 lett. a OTLEF; DTF 125 III 383 cons. 2a) e che per lo stesso motivo non si assegnano indennità (art. 62 cpv. 2 OTLEF);

richiamati gli art. 20a cpv. 1, 159 LEF, 9 LPR, 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF;

pronuncia:

  1. Il ricorso 21 febbraio 2002 di __________, è respinto.

  2. Non si prelevano tasse, né si assegnano indennità.

  3. Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
