RI 1 appealed against the conduct of the enforcement office in enforcement no. 653884. During the appeal, PI 1 withdrew the request for continuation of the enforcement. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal, acting as supervisory authority, held that the appeal had thereby become moot and struck it from the docket. The court also ordered that no fees be charged and no indemnities be awarded. An appeal to the Federal Debt Enforcement and Bankruptcy Chamber was indicated within ten days.
Art. 24b cpv. 1 LPR; an appeal in enforcement proceedings becomes moot and must be struck from the docket when the challenged enforcement step loses practical significance through withdrawal of the continuation request. In such a situation, the supervisory authority issues no substantive ruling on the merits. Pursuant to Art. 61 cpv. 2 lett. a and Art. 62 cpv. 2 OTLEF, no court fee is levied and no party indemnity is awarded where the case is removed from the docket as devoid of object.

considerato come la procedura ricorsuale sia così divenuta priva d’oggetto e debba di conseguenza essere stralciata dai ruoli (art. 24b cpv. 1 LPR);
ricordato che non si preleva la tassa di giustizia e non si assegnano indennità (art. 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF);
richiamati gli art. 17, 20a LEF; 24b cpv. 1 LPR; art. 61 e 62 OTLEF;
pronuncia: 1. Il ricorso 7 marzo 2005 di RI 1, , è stralciato dai ruoli in quanto divenuto privo di oggetto.
Non si prelevano spese e non si assegnano indennità.
Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
