l’operato dell’CO 1, e meglio contro l’avviso di pignoramento emesso il 18 maggio 2006 nell’esecuzione n° __________ promossa contro il ricorrente da

viste le osservazioni 31 maggio 2006 dell’CO 1;

esaminati atti e documenti;

ritenuto in fatto e considerato in diritto:

che la ricevibilità formale del ricorso appare dubbia, siccome non contiene nessuna domanda esplicita, né la designazione dell’atto impugnato (il quale, in contrasto con l’art. 7 cpv. 4 lett. a LPR, non è stato prodotto);

che secondo le osservazioni dell’Ufficio, non contestate dal ricorrente, oggetto dell’impugnazione sembra essere l’avviso di pignoramento emesso il 18 maggio 2006 nell’esecuzione n° __________;

che a prescindere dalle carenze formali del ricorso non occorre fissare al ricorrente il termine di cui all’art. 7 cpv. 5 LPR per completarlo;

che infatti questa Camera è comunque incompetente per pronunciarsi sugli argomenti esposti dal ricorrente, i quali d’acchito non concernono la procedura esecutiva ma semmai il credito posto in esecuzione (tasse di giudizio, spese e onorari stabiliti nella sentenza 8 luglio 2005 della Camera dei ricorsi penali del Tribunale d’appello, inc. __________);

che dal profilo formale – che in questa sede è l’unico pertinente –, l’CO 1 ha correttamente proceduto all’emissione dell’avviso di pignoramento, in base alla domanda 9 maggio 2006 del procedente, corredata dalla sentenza 28 febbraio 2006 del Giudice di pace del circolo di __________, con cui l’opposizione del debitore veniva respinta in via definitiva;

che il ricorso è pertanto irricevibile;

che non si preleva la tassa di giustizia e non si assegnano indennità (art. 61 cpv. 2 lett. a, e 62 cpv. 2 OTLEF).

Richiamati gli art. 17, 20a, 90 LEF; 7 LPR; 61, 62 OTLEF;

pronuncia:

  1. Il ricorso 23 maggio 2006 di RI 1, __________, è irricevibile.

  2. Non si prelevano spese, né si assegnano indennità.

  3. Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
