statuendo sul ricorso 20 febbraio 1995 di
contro
la risoluzione 1. febbraio 1995, no. 640, del Consiglio di Stato che respinge l'impugnativa presentata dall'insorgente avverso la decisione 22 novembre 1994 del municipio di __________ con la quale si ordinava lo sgombero del materiale abusivamente depositato al mapp. no. __________ RFD di __________ e il ripristino del terreno naturale della scarpata;
preso atto che in occasione dell’udienza di sopralluogo del 13 ottobre 1995, dopo ampia discussione, su proposta del Giudice Delegato le parti sono addivenute alla seguente transazione:
"1. Il signor __________ si impegna ad asportare tutto il materiale aggiunto in occasione della costruzione del signor __________ ed a ridurre lo slargo esistente alle dimensioni massime di m 2.50.
Si impegna inoltre ad eseguire le opere di consolidamento del terreno che gli verranno specificate dal municipio.
A queste condizioni il signor __________ dichiara di ritirare il ricorso.
Le parti dichiarano di accettare la transazione. La causa verrà stralciata dai ruoli senza spese e tassa di giustizia."
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
