The appellant withdrew its appeal against the State Council decision concerning a parish tax levy for 1989/90. The Ticino Administrative Court therefore struck the appeal from the roll. In view of the withdrawal, no court fees or expenses were charged. However, the court treated the withdrawal as equivalent to defeat for the allocation of party compensation and ordered the appellant to pay CHF 300 to the respondent.

Where the appellant desists from the appeal, the proceedings are struck out without a merits determination. For the purposes of compensation, withdrawal is assimilated to defeat, so that the withdrawing party may be ordered to pay party compensation to the other side, even if no court fees or disbursements are levied. The court may take into account intervening legislative changes that prompted the withdrawal.

Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
