Is an appeal admissible against a decision granting, refusing, or withdrawing suspensive effect in debt-enforcement complaint proceedings?
No. Such a decision is purely procedural and not an enforcement measure, and neither the LP nor cantonal procedural law provides a remedy against it.
The court held that complaints to the supervisory authority can challenge only a measure or decision of an enforcement organ. The grant or refusal of suspensive effect is procedural only. There is therefore no appeal under federal debt-enforcement law, and Vaud procedural law likewise provides none; the CPC does not apply to complaint proceedings.
