Tenor

Das Versäumnisurteil vom 30. 7. 2004 bleibt mit der Maßgabe aufrechterhalten, dass die Beklagte verurteilt wird, an die Klägerin ein angemessenes Schmer-zensgeld von 750 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basis-zinssatz seit dem 7. 7. 2004 zu zahlen.

Im Übrigen wird das Versäumnisurteil vom 30. 7. 2004 aufgehoben und die Klage abgewiesen.

Von den Kosten des Rechtsstreits haben die Klägerin 5/6 und die Beklagte 1/6 zu tragen. Dies gilt nicht für die durch das Versäumnisurteil vom 30. 7. 2004 verur-sachten Säumniskosten, welche die Beklagte zu tragen hat.

Das Urteil ist vorläufig vollstreckbar. Die Parteien können die Vollstreckung gegen Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreckbaren Betra-ges abwenden, sofern nicht die Gegenpartei in gleicher Höhe Sicherheit leistet.
