Omnilex-Zusammenfassung

In divorce proceedings, the Altena District Court severed the pension-equalisation matter from the decision bundle under § 628(1) no. 3 ZPO (new). It considered unconstitutional the application of pension equalisation to marriages concluded before 1 July 1977, as well as rules requiring equalisation irrespective of whether the beneficiary survives to the pension event, dies before the obligated spouse, or obtains adequate lasting old-age provision through remarriage. The court also challenged Article 12 no. 3, paragraphs 1, 3 and 4 of the First Marriage Reform Act and related pension-insurance rules. It stayed the severed proceedings and referred the constitutional question to the Federal Constitutional Court under Article 100(1) GG.

Omnilex-Regeste

Article 100(1), first sentence, GG; § 628(1) no. 3 ZPO (new); pension equalisation under §§ 1587–1587p BGB (new). A court that considers statutory provisions decisive to its judgment and unconstitutional must stay the proceedings and refer the question to the Federal Constitutional Court. The referral here concerns the temporal application of pension equalisation to marriages concluded before 1 July 1977 and the statutory scheme's operation without regard to whether the beneficiary experiences the pension event, predeceases the obligated spouse, or obtains adequate and lasting old-age provision through remarriage. The pension-equalisation matter may be severed from the divorce decision bundle under § 628(1) no. 3 ZPO (new).
