Omnilex-Zusammenfassung

In divorce proceedings, the Altena Local Court replaced its order of 5 September 1977 and severed the pension-equalization matter from the divorce decision. It considered the transitional extension of pension equalization to marriages concluded before 1 July 1977 unconstitutional. It also challenged the statutory scheme insofar as equalization was to be carried out and maintained regardless of whether the beneficiary survived to the pension event, whether the beneficiary died before the obligor without reversion of the pension, or whether remarriage provided adequate lasting retirement provision. The court further considered specified transitional provisions unconstitutional. It stayed the severed matter and referred the constitutional questions to the Federal Constitutional Court.

Omnilex-Regeste

Art. 100 para. 1 GG; referral for constitutional review of provisions governing pension equalization: The referring court considers the transitional application of statutory pension equalization to marriages concluded before 1 July 1977 unconstitutional. It further questions a scheme requiring judicial and insurance-law implementation and continued payment irrespective of whether the beneficiary lives to the pension event, dies before the obligor without a reversion of the pension, or obtains adequate and lasting retirement provision through remarriage. The constitutional doubts also extend to Art. 12 No. 3 para. 3 sentences 3 and 4 of the First Marriage Reform Act. The referred matter is severed and stayed pending the Federal Constitutional Court's decision.
