Leitsätze

Bleche in Doppelstockern in einer Tiefgarage stellen Sondereigentum dar, da sie nicht zu den tragenden konstruktiven Teilen einer Tiefgarage gehören und auch nicht dem gemeinschaftlichen Gebrauch der Eigentümer dienen.

Tenor

  1. Der Beschluß der Eigentümerversammlung vom 26.04.1991 zu TOP 5 (Wirtschaftsplan 1991 mit Beschlußfassung - einschließlich Instandhaltungsplan 1992 bis 1995) wird hinsichtlich der Position 17.2 "Sanierung der Doppelstocker in der Tiefgarage im Wirtschaftsplan und im Instandhaltungsplan" für ungültig erklärt.

  2. Die Gerichtskosten sind aus den gemeinschaftlichen Mitteln zu zahlen und nach dem allgemeinen Verteilungsschlüssel auf die Wohnungseigentümer umzulegen.

Außergerichtliche Kosten werden nicht erstattet.

  1. Der Geschäftswert wird auf 5.000 DM festgesetzt.
