Omnilex-Zusammenfassung

The Bonn Local Court granted the applicants access to the Federal Cartel Office’s file in the form of the Office’s 12 April 2010 decision, as modified by its 21 May 2010 letter. The modification requires redaction of references to U-versicherung and U1 Versicherung in the administrative fine notice. The court held that applicants seeking access under § 406e StPO need not establish that damages claims actually exist. It is enough that such claims may exist, since file access serves to let potential claimants assess whether they have a claim.

Omnilex-Regeste

StPO § 406e; legitimate interest in file inspection by potential injured parties. A person seeking access to case files to examine possible damages claims need not establish that a claim already exists. It is sufficient that a claim may exist. The access right is intended to place a potentially entitled person in a position to assess whether damages claims can be asserted; requiring proof of the claim before granting access would frustrate that purpose.

In diesem Schreiben vom 21.

A legitimate interest does not require proof that damages claims actually exist; it is sufficient that such claims may exist, because access enables potential claimants to assess them.

The purpose of file access under § 406e StPO is to enable a potentially entitled person to examine whether damages claims exist. The applicants therefore need not first establish an actual claim.
