Omnilex-Zusammenfassung

The Bonn Local Court dismissed both the claim and the counterclaim in a tenancy dispute concerning a possible discrepancy in living area. It stated that a hallway may count as living area where the tenant uses it beyond the ordinary extent, particularly by keeping substantial furniture there. Repayment claims based on a material living-area discrepancy are subject to the regular limitation period. For limitation to begin, it is sufficient that the tenant knows the actual lengths, widths, and heights of the rooms; this will generally be the case shortly after moving in. The plaintiff was ordered to bear one tenth of the costs and the defendant nine tenths.

Omnilex-Regeste

BGB §§ 536, 812(1), 195 and 199; treatment of a hallway as living area and limitation of repayment claims based on a living-area discrepancy. Whether a hallway forms part of the living area depends on the circumstances of the individual case. Its use beyond the ordinary extent, particularly the storage of furniture on a substantial scale, may justify including it. Repayment claims arising from a material discrepancy in living area are subject to the regular limitation period. The limitation period begins when the claimant has the knowledge required under the applicable rules; knowledge of the actual lengths, widths and heights of the rooms is sufficient. Such factual knowledge will generally be acquired shortly after the tenant moves in.

Leitsätze
