Omnilex-Zusammenfassung

In insolvency proceedings, a creditor applied on 1 October 2014 for denial of discharge. The Bonn District Court rejected the application and ordered the applicant to bear the costs it had caused. The court stated that a claim established in the insolvency schedule establishes creditor status regardless of when the establishment occurs. If the insolvency administrator or trustee disputes the claim, creditor status—and consequently standing to seek denial of discharge—is not established.

Omnilex-Regeste

InsO § 290 para. 1; creditor standing to apply for denial of discharge. A creditor whose insolvency claim has been established in the schedule has creditor status for purposes of applying under § 290 para. 1 InsO; the time at which the claim is established is immaterial. If the insolvency administrator or trustee disputes the claim, creditor status is not established, and the applicant consequently lacks the standing required to bring the application.

insolvencycreditor standingdenial of dischargeinsolvency scheduledisputed claim

Creditor standing exists when an insolvency claim is established in the schedule, regardless of when it is established; it is not established when the claim is disputed by the insolvency administrator or trustee.

A disputed claim does not establish the applicant's status as a creditor and therefore does not establish entitlement to apply.

The applicant must bear the costs caused by the application.
