Omnilex-Zusammenfassung

The landlords brought an eviction action against their tenants. The court found that the tenants continued to pay rent late over an extended period despite two warnings and had also sublet the property without authorization. It ordered the tenants jointly and severally to vacate and return the house, including its two apartments, ancillary spaces, garden, and two parking spaces. The tenants were granted until 30 April 2015 to vacate and were ordered to bear the litigation costs jointly and severally. The judgment was provisionally enforceable, subject to the stated security arrangement.

Omnilex-Regeste

BGB §§ 546 Abs. 1, 985; termination of a tenancy for persistent late payment of rent and unauthorized subletting. Continued untimely rent payments may justify termination where they persist over an extended period despite two warnings. The assessment may also take account of an unauthorized subletting occurring alongside the repeated payment delays. In such circumstances, the combined conduct can entitle the landlord to recover possession of the rented property.
