Consumer status despite business-address invoicing

Omnilex-Zusammenfassung

The Bonn Local Court ordered the defendant to repay the plaintiff €1,200 for an alarm system, against its return, and declared the defendant in default of acceptance. It also awarded €169.50 in pre-litigation attorney fees, with interest, and charged the defendant with the litigation costs. In assessing consumer status, the court held that invoicing at a business address did not by itself make the purchase an entrepreneurial transaction where the other circumstances indicated that the buyer acted as a consumer. A suspicion that the buyer intended to defraud the tax authorities had no bearing on that civil-law classification.

Omnilex-Regeste

BGB §§ 13, 312b; consumer status in a purchase transaction; the fact that an invoice is to be sent to a business address does not, by itself, establish that the buyer acted in the course of a commercial or independent professional activity. Consumer status is assessed in light of the circumstances as a whole, and the address for invoicing is not conclusive where the other circumstances indicate a consumer transaction. A suspicion that the buyer sought to defraud the tax authorities is irrelevant to the civil-law classification of the buyer as consumer or entrepreneur.
