Tenor

Die Beklagte wird verurteilt, 25,00 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 09.06.2015 sowie vorgerichtliche Rechtsanwaltskosten in Höhe von 85,53 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 15.09.2015 an den Kläger zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger.

Das Urteil ist vorläufig vollstreckbar.

Jede Partei kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des jeweils für sie aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
