Omnilex-Zusammenfassung

The plaintiffs challenged a resolution adopted by the condominium owners’ meeting on 14 June 2017. The resolution revoked permission for child day care at the property and called for the operation to cease. The Bonn District Court declared the resolution invalid. Applying a typical assessment of the effects on co-owners, it held that care for only two to three children does not cause greater interference. The defendants were ordered to bear the costs of the proceedings.

Omnilex-Regeste

WEG §§ 14 no. 1, 15(3); BGB § 1004(1); interference with co-owners from child day care. In assessing whether use of a condominium property causes an impermissible impairment, the effects are determined by a typical, not merely individual, assessment. Child day care involving only two to three children does not, as a rule, cause greater impairment to the other co-owners. A resolution requiring cessation of such use cannot therefore be upheld on the ground that the activity exceeds the impairment they must tolerate.
