Omnilex-Zusammenfassung

In this concluding judgment, Bonn District Court ordered the defendant to pay the plaintiff interest at five percentage points above the base rate on EUR 750 from 23 August 2017, and dismissed the remainder of the claim. The court stated that a tenant does not, merely by using a vehicle's drink holder for hot drinks while driving, grossly negligently breach duties under the rental agreement. The plaintiff was ordered to bear the costs of the proceedings. The judgment was declared provisionally enforceable.

Omnilex-Regeste

BGB §§ 277, 276, 280, 535; gross negligence in the use of a rented vehicle: A tenant does not grossly negligently breach contractual duties merely by using a vehicle's provided drink holder for hot drinks while driving. The presence of a holding device designed for drinks does not, without further circumstances, make that use a grossly negligent disregard of the tenant's duties.

Use of the drink holder for hot drinks while driving did not, by itself, amount to gross negligence or breach of the tenant's contractual duties.

The vehicle was rented with a device intended to hold drinks; using it for hot drinks while driving alone did not establish gross negligence.

The defendant must pay interest at five percentage points above the base rate on EUR 750 from 23 August 2017.

The remainder of the claim was rejected.

The plaintiff bears the costs of the proceedings.
