Omnilex-Zusammenfassung

The landlord sued to recover an apartment after the tenant fed 40–90 pigeons, causing substantial hygienic and acoustic disturbance to other tenants. The Bonn Local Court held that this conduct justified extraordinary termination of the residential lease under BGB §§ 543(1) and 546(1). It ordered the tenant to vacate and surrender the apartment, including all keys, and granted a move-out period through 31 May 2018. The tenant was also ordered to pay EUR 429.89 in pre-litigation attorney and service costs and to bear the litigation costs. The judgment was declared provisionally enforceable.

Omnilex-Regeste

BGB §§ 543(1), 546(1); extraordinary termination of a residential lease and the resulting claim for surrender may be justified where a tenant’s conduct causes substantial disturbance to other occupants. Feeding pigeons may constitute such conduct when the resulting immissions are materially burdensome in hygienic and acoustic respects. Feeding 40–90 pigeons meets that threshold. The relevant assessment concerns the effects on fellow tenants, including the scale of the activity and the resulting nuisance.
