Tenor
Der Beklagte wird verurteilt, die Einstellung der Versorgung in der Abnahmestelle L-Straße 10 in D über den Stromzähler Nr. ### zu dulden, soweit die Klägerin 3 Werktage vor der Einstellung diese ankündigt.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 2/3 und der Beklagte zu 1/3.
Das Urteil ist vorläufig vollstreckbar.
Die Klägerin kann die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des gesamten vollstreckbaren Betrags abwenden, wenn nicht der Beklagte vor der Zwangsvollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrags leistet.
Die Berufung wird zugelassen.
