The plaintiff sued the owners of neighboring property over roots from their roadside cedar, which exerted pressure on the plaintiff’s boundary wall and footpath and had damaged the wall. In written proceedings, the District Court Düsseldorf ordered the defendants jointly and severally to remove the root pressure and prevent future effects, and to have the wall damage professionally repaired. The court declared the footpath-damage issue moot. It dismissed the claim in other respects and allocated 95% of the litigation costs to the defendants and 5% to the plaintiff.
A property owner may be required to take suitable measures against root effects from a tree on the owner’s land when those effects interfere with a neighboring property. Where roots have already damaged a boundary structure, the court may also order that the damage be professionally repaired. The specific scope of the required measures depends on the interference and the relief sought. No statutory provisions or further general legal principles are identified in the decision text provided.
