Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Münster vom 14. Juli 2011 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat, dass auf Anlasstaten, die vor dem 1. Januar 2011 begangen wurden, die Vorschrift des § 66 StGB in der bis zum 31. Dezember 2010 geltenden Fassung und nicht in der am 1. Januar 2011 in Kraft getretenen Neufassung anzuwenden ist (Art. 316e Abs. 1 EGStGB). Dies gilt nach Art. 316e Abs. 2 EGStGB nicht, wenn im konkreten Fall eine Anwendung von § 66 StGB in der am 1. Januar 2011 in Kraft getretenen Neufassung dazu führt, dass die rechtlichen Voraussetzungen für eine Unterbringung in der Sicherungsverwahrung nicht mehr gegeben sind (BGH, Beschluss vom 8. Juni 2011 – 4 StR 127/11, NStZ 2011, 691). Eine Kombination von Elementen aus beiden Vorschriften kommt nicht in Betracht.
