Tenor

Auf die Revision des Angeklagten wird das Urteil des Landgerichts Darmstadt vom 27. Juli 2011 im Strafausspruch dahin geändert, dass die Jugendstrafe auf drei Jahre und sechs Monate festgesetzt wird.

Die weitergehende Revision wird verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dem Nebenkläger im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Gründe

1 Das Landgericht hat den Angeklagten wegen versuchten Totschlags in Tateinheit mit gefährlicher Körperverletzung zu einer Jugendstrafe von drei Jahren und neun Monaten verurteilt. Seine auf die Sachrüge gestützte Revision führt zu der aus der Beschlussformel ersichtlichen Änderung, im Übrigen erweist sie sich als unbegründet im Sinne von § 349 Abs. 2 StPO.

2 Der Strafausspruch hat keinen Bestand. Nach der Urteilsformel im schriftlichen Urteil beträgt die verhängte Jugendstrafe drei Jahre und neun Monate, nach den Urteilsgründen (UA S. 24) hingegen nur drei Jahre und sechs Monate. Worauf der Widerspruch beruht, lässt sich dem Urteil nicht entnehmen. Um ein offenkundiges Fassungsversehen, das eine Berichtigung zulassen könnte, handelt es sich nicht, weil - worauf der Generalbundesanwalt zu Recht hinweist - den in sich folgerichtigen und rechtlich einwandfreien Strafzumessungsgründen nicht zu entnehmen ist, dass die dort bezeichnete niedrigere Jugendstrafe ohne jeden vernünftigen Zweifel von der Kammer so nicht verhängt werden sollte. Auszuschließen ist aber, dass die Strafkammer eine niedrigere als die in den Gründen genannte verhängen wollte. Der Senat ist daher nicht gehindert, auf die niedrigere von beiden Strafen zu erkennen (Senat, Beschlüsse vom 15. Juni 2011 - 2 StR 194/11 und vom 17. März 2004 - 2 StR 516/03; BGH, Beschluss vom 25. Februar 2009 - 5 StR 46/09, Beschluss vom 1. September 2010 - 5 StR 262/10, BGHR StPO § 260 Abs. 1 Urteilstenor 5 mwN) und hat diese, dem Antrag des Generalbundesanwalts folgend, selbst festgesetzt.

3 Im Hinblick auf den nur geringen Teilerfolg der Revision des Beschwerdeführers ist es nicht unbillig, ihn mit den gesamten Kosten des Rechtsmittels zu belasten (§ 473 Abs. 1 und 4 StPO).
