Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Oldenburg vom 11. November 2011 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO); jedoch wird der Schuldspruch dahin neu gefasst, dass das Wort "gemeinschaftlichen" entfällt (vgl. BGH, Beschluss vom 12. Oktober 1977 - 2 StR 410/77, BGHSt 27, 287, 289).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend zu der Antragsschrift des Generalbundesanwalts bemerkt der Senat:

Dass das Landgericht einen Vermögensverlust großen Ausmaßes (§ 263 Abs. 3 Satz 2 Nr. 2 Alt. 1 StGB) angenommen hat, begegnet keinen Bedenken. Zwar hat die Strafkammer Anzahl und Höhe der durch die Geschädigte auf fingierte Rechnungen geleisteten Zahlungen im Tatzeitraum von etwa dreieinhalb Monaten nicht im Einzelnen festgestellt. Grundsätzlich ist bei der opferbezogenen Bestimmung des Ausmaßes der - allein maßgeblichen - Vermögenseinbuße auf die einzelne Betrugstat abzustellen. Nichts anderes gilt bei Betrugsserien, die nach den Kriterien der rechtlichen oder natürlichen Handlungseinheit eine Tat bilden. In diesen Fällen ist eine Addition der Einzelschäden indes zulässig, wenn die tateinheitlich zusammentreffenden Taten dasselbe Opfer betreffen (BGH, Beschluss vom 15. März 2011, 1 StR 529/10, NJW 2011, 1825, 1827). So verhält es sich hier.
