Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 15. Zivilsenats in Kassel des Oberlandesgerichts Frankfurt am Main vom 27. Mai 2010 wird auf Kosten des Klägers zurückgewiesen.

Der Wert des Beschwerdeverfahrens wird auf 200.000 € festgesetzt.

Gründe

1 Die Nichtzulassungsbeschwerde ist statthaft (§ 544 Abs. 1 Satz 1 ZPO) und zulässig (§ 544 Abs. 1 Satz 2, Abs. 2 ZPO). Sie hat jedoch keinen Erfolg.

2 Die Verpachtung eines land- und forstwirtschaftlichen Betriebs kann eine nach § 1 Abs. 1 AnfG anfechtbare Rechtshandlung darstellen. Weggegeben und deshalb im Falle einer erfolgreichen Anfechtung vom Pächter dem Gläubiger nach § 11 Abs. 1 AnfG zur Verfügung zu stellen sind die Nutzungen des Pachtgegenstands. Dazu gehört auch der aus dem Gewerbebetrieb gezogene Gewinn, soweit dieser nicht auf den persönlichen Leistungen oder Fähigkeiten desjenigen beruht, der die gewinnbringenden Einnahmen erzielt hat (vgl. BGH, Urteil vom 5. Juli 2006 - VIII ZR 172/05, BGHZ 168, 220 Rn. 46; MünchKomm-AnfG/Kirchhof, § 11 Rn. 92, 105, 132 f). Die Gläubigeranfechtung ermöglicht hingegen nicht den Zugriff auf einzelne vom Pächter im Rahmen des von ihm geführten Gewerbebetriebs erlangte Forderungen wie etwa die hier in Rede stehenden Subventionsprämien. Die einzelnen Forderungen kommen auch nicht als selbständiger Gegenstand einer Gläubigeranfechtung in Betracht, denn sie sind erst in der Person des Pächters neu entstanden; aus dem Vermögen des Verpächters wurde insoweit nichts weggegeben.

3 Mit dieser Rechtslage stimmt das Berufungsurteil überein. Eine Entscheidung des Revisionsgerichts ist weder zur Klärung grundsätzlicher Rechtsfragen noch zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung erforderlich (§ 543 Abs. 2 Satz 1 ZPO).
