Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Berlin vom 30. Januar 2015 wird nach § 349 Abs. 2 StPO als unbegründet verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend zur Antragsschrift des Generalbundesanwalts vom 15. Mai 2015 bemerkt der Senat:

Das Tatgericht ist zwar bei der Strafrahmenwahl verpflichtet, in einer Gesamtwürdigung zu prüfen, ob es den nach § 49 StGB gemilderten Regelstrafrahmen oder denjenigen eines minder schweren Falls anwendet (vgl. BGH, Beschluss vom 11. August 1987 - 3 StR 341/87, BGHR StGB vor § 1 minder schwerer Fall Strafrahmenwahl 4). Es ist indes nicht verpflichtet, den jeweils für den Angeklagten günstigeren Strafrahmen zugrunde zu legen; es unterliegt vielmehr seiner pflichtgemäßen Entscheidung, welchen Strafrahmen es wählt (vgl. BGH, Urteile vom 3. Mai 1966 - 5 StR 173/66, BGHSt 21, 57, 59; vom 19. Januar 1982 - 1 StR 734/81, NStZ 1982, 200; Lackner/Kühl, StGB, 28. Aufl., § 50 Rn. 2; Schäfer/Sander/van Gemmeren, Praxis der Strafzumessung, 5. Aufl., Rn. 933; aA Theune in LK-StGB, 12. Aufl., § 50 Rn. 15 f.; Horn/Wolters, SK-StGB, 8. Aufl., § 50 Rn. 5; Fischer, StGB, 62. Aufl., § 50 Rn. 5). Der Zweifelssatz findet insofern keine Anwendung.
