Omnilex-Zusammenfassung

The Federal Labour Court decided a revision in an employment wage dispute. The plaintiff had sought a declaration that the defendant state was obliged to pay base salary under pay group IIa BAT at the highest age step for the period from 1 June 2008 to 31 October 2008. The Court partly set aside the Hessian Labour Court's judgment and held the plaintiff's appeal inadmissible insofar as it concerned that declaratory claim. The plaintiff was ordered to bear the costs of the appeal and revision. The decision was issued without factual findings and reasons because the parties waived them in light of the parallel lead case.

Omnilex-Regeste

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: Where the parties waive findings of fact and reasons in view of a lead parallel case, the Federal Labour Court may dispose of the revision accordingly. An appeal is inadmissible insofar as it is directed against a declaratory ruling on a precisely delimited wage entitlement period when the procedural prerequisites for appellate review are lacking. The Court may therefore partly set aside the appellate judgment and reject the appeal as inadmissible; costs follow the outcome of the revision proceedings.
