The Federal Labor Court, on the defendant's revision, set aside the Baden-Württemberg Regional Labor Court's judgment and amended the Mannheim Labor Court's judgment to dismiss the claim. Auf die Berufung des Beklagten wird das Urteil des Arbeitsgerichts Mannheim vom 13. Januar 2010 - 13 Ca 62/09 - abgeändert und die Klage abgewiesen.
Der Kläger hat die Kosten des Rechtsstreits zu tragen.
