Leitsatz

Ein Rechtsmittel, das bereits vor der Unterbrechung des Verfahrens unzulässig war, kann in entsprechender Anwendung des § 249 Abs. 3 ZPO auch während der Unterbrechung des Verfahrens verworfen werden (Anschluss BGH, 16. Januar 1959, I ZR 33/58, NJW 1959, 532).

Tenor

Die am 3. Juni 2013 eingelegte Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem den Prozessbevollmächtigten der Klägerin am 2. Mai 2013 zugestellten Beschluss des 27. Zivilsenats des Oberlandesgerichts München vom 15. April 2013 - 27 U 4772/12 - wird auf ihre Kosten verworfen, weil die Beschwerde nicht innerhalb von einem Monat nach Zustellung des angefochtenen Beschlusses durch einen beim Revisionsgericht zugelassenen Rechtsanwalt eingelegt worden ist (§§ 544 Abs. 1, 78 Abs. 1, 97 Abs. 1 ZPO).

Die Verwerfung der Nichtzulassungsbeschwerde wird durch die Eröffnung des Insolvenzverfahrens über das Vermögen der Klägerin durch Beschluss des Amtsgerichts L. vom 28. August 2013 ( ) und die hierdurch gemäß § 240 Satz 1 ZPO eingetretene Verfahrensunterbrechung nicht gehindert. Ein Rechtsmittel, das - wie hier - bereits vor der Unterbrechung des Verfahrens unzulässig war, kann in entsprechender Anwendung des § 249 Abs. 3 ZPO auch während der Unterbrechung des Verfahrens verworfen werden (BGH, Beschluss vom 16. Januar 1959 - I ZR 33/58, NJW 1959, 532; OLG Düsseldorf, MDR 2001, 470; OLG München, NJOZ 2004, 2619; Roth in Stein/Jonas, ZPO, 22. Aufl., § 249 Rn. 19 mwN; MünchKommZPO/Gehrlein, 4.
