Tenor

Die Beschwerde gegen die Nichtzulassung der Revision im Urteil des 27. Zivilsenats des Oberlandesgerichts Hamm vom 4. September 2012 wird auf Kosten des Klägers zurückgewiesen.

Der Streitwert wird auf 1.005.454,36 € festgesetzt.

Gründe

1 Die Beschwerde deckt keinen Zulassungsgrund auf.

2 1. Zu Unrecht leitet die Beschwerde die geltend gemachte Zahlungsforderung aus einer Vorsatzanfechtung (§ 133 Abs. 1 und 2 InsO) her.

3 Soweit das Berufungsgericht die subjektiven Voraussetzungen des § 133 Abs. 1 InsO nicht festgestellt hat, werden dagegen keine durchgreifenden Zulassungsrügen erhoben. Die Vorschrift des § 133 Abs. 2 InsO ist vorliegend jedenfalls schon deshalb nicht einschlägig, weil die Frist des § 133 Abs. 2 Satz 2 InsO nicht gewahrt ist und es infolge der Verrechnung der Darlehensforderung der K. GmbH & Co. KG mit dem Abfindungsanspruch der Beklagten an einer unmittelbaren Gläubigerbenachteiligung fehlt (vgl. MünchKomm-InsO/Kirchhof, 2. Aufl., § 129 Rn. 149).

4 2. Soweit die Beschwerde die Nichtanwendung des § 181 BGB durch das Berufungsgericht beanstandet, liegt der geltend gemachte Gehörsverstoß (Art. 103 Abs. 1 GG) nicht vor. Die Beschwerde vermag kein übergangenes tatsächliches Vorbringen zu bezeichnen. Eine vermeintlich fehlerhafte rechtliche Würdigung kann nicht in einen Gehörsverstoß gekleidet werden.

5 3. Im Übrigen wird von einer Begründung nach § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen.
