Omnilex-Zusammenfassung

The 2nd Criminal Senate of the BGH agreed with the requesting 3rd Criminal Senate that the variants of concealment and enabling a third party to obtain benefits under § 259 StGB must be distinguished by determining in whose sphere the offender objectively and subjectively acts. The Senate expressly abandoned its earlier contrary case law from 1978 and 1990, considering it outdated, poorly reconcilable with the statutory wording, and internally inconsistent. The decision is an inter-senate alignment on the interpretation of the offense concept, not a merits judgment in a concrete criminal case.

Omnilex-Regeste

§ 259 StGB; distinction between the variants of concealment and enabling a third party to obtain proceeds; the differentiation is to be made according to the offender’s objective and subjective affiliation to the respective ‘camp’. Earlier case law treating the variants differently is not maintained if it is no longer convincing in light of statutory amendments, the wording of the provision, and systematic considerations (consid. 1). The task of developing precise delimitation criteria remains with the courts.

BGH — 2 ARs 299/13, Beschluss

Entscheidungsdatum: 2013-08-15

Aktenzeichen: 2 ARs 299/13

Dokumenttyp: Beschluss

Vorinstanz: nachgehend BGH, 22. Oktober 2013, Az: 3 StR 69/13, Beschluss

Spruchkörper: 2. Strafsenat

Tenor

Kernrechtsfrage

How are the variants of concealment and enabling a third party to obtain proceeds under § 259 StGB to be distinguished?

Extrahierter Entscheid

The distinction should be made by asking in whose 'camp' the offender objectively and subjectively acts; no reason remains to adhere to the earlier contrary approach.

Extrahierte Begründung

The court follows the literature and the requesting senate, noting that earlier case law is outdated due to legislative changes, scarcely compatible with the text, and systemically inconsistent. Clear criteria should be developed by the courts.
