Omnilex-Zusammenfassung

The Federal Constitutional Court rejected an application for an interim injunction against a sitzungspolizeiliche order in the NSU criminal trial. The applicant objected to the copying and temporary retention of ID documents presented at entrance checks. The Court held that, even if the constitutional complaint were admissible and not obviously unfounded, the balancing of interests under Section 32 BVerfGG did not clearly favor granting interim relief. The burden on the applicant was insufficient to outweigh the interests in orderly courtroom proceedings under Section 176 GVG.

Omnilex-Regeste

§ 32 BVerfGG; interim injunction against a courtroom security order; requirements for balancing of interests. Interim relief is granted only where the consequences of non-issuance would clearly outweigh the consequences of issuance. If the constitutional complaint is not manifestly inadmissible or unfounded, a hypothetical balancing is required, taking into account the interests in orderly conduct of the hearing under § 176 GVG. A courtroom measure affecting admission control, such as copying and temporary retention of ID documents, does not justify suspension where the interference is not of such weight as to clearly outweigh the interest in orderly proceedings (consid. 1 f.).

Titelzeile

BVerfG, a.a.O., Rn. 4), deutlich überwiegt.

Diese Entscheidung ist unanfechtbar.

Kernrechtsfrage

Whether an interim injunction should suspend the courtroom order to copy and temporarily retain ID documents at admission control.

Extrahierter Entscheid

The request was denied because the balancing of interests did not show the clear predominance required for interim relief; the burden on the applicant did not clearly outweigh the interests in orderly courtroom proceedings.

Extrahierte Begründung

Even assuming the constitutional complaint was admissible and not manifestly unfounded, the required balancing under Section 32 BVerfGG did not favor suspension. The measure served the orderly conduct of the hearing under Section 176 GVG.
