Omnilex-Zusammenfassung

The Federal Constitutional Court rejected the applicant's request for interim constitutional relief. It held that the subsidiarity principle applies equally to constitutional interim proceedings and that the applicant had not demonstrated exhaustion of available specialized interim remedies. The Court also noted that the application lacked a sufficiently concrete decisive factual basis. No further reasons were given under § 93d Abs. 1 sentence 3 BVerfGG.

Omnilex-Regeste

§ 93d Abs. 1 Satz 3 BVerfGG; subsidiarity of constitutional interim relief; an application for an interim injunction is inadmissible if the applicant has not first exhausted available fachgerichtlicher Eilrechtsschutz. The principle of subsidiarity governing constitutional complaints applies mutatis mutandis to preliminary constitutional protection proceedings. The Constitutional Court may dispense with further reasoning where the legal situation is clear and no decision-relevant facts are sufficiently substantiated. Consideration 1 emphasizes that, absent exhaustion of ordinary remedies, constitutional interim relief cannot serve as a substitute for pending specialized judicial protection.

Titelzeile

Kernrechtsfrage

Whether the application for a constitutional interim injunction was admissible despite the subsidiary nature of constitutional relief.

Extrahierter Entscheid

The application was inadmissible because the applicant had not shown that available specialized interim remedies had first been exhausted.

Extrahierte Begründung

The subsidiarity principle also applies to preliminary constitutional relief. Apart from the lack of a sufficiently concrete decisive factual basis, it was not apparent that the applicant had pursued fachgerichtlicher Eilrechtsschutz before applying to the Constitutional Court.
