Omnilex-Zusammenfassung

The Federal Constitutional Court rejected an application for an interim order aimed at preventing the entry into force of §§ 113b and 113c TKG, introduced by the 10 December 2015 data retention act. It held that the applicant had not demonstrated that the harms from allowing the law to enter into force and later finding it unconstitutional would clearly outweigh the harms caused by temporarily blocking a law that might ultimately be constitutional. The decision is final.

Omnilex-Regeste

Art. 32 Abs. 1 BVerfGG; interim relief against the entry into force of a statute is granted only where the balance of consequences clearly favours provisional suspension. The Court applies a strict weighing of the disadvantages of enforcement against those of preventing a potentially constitutional law from taking effect. Mere uncertainty as to the constitutionality of the statute does not suffice; the applicant must show a manifest predominance of the irreversible disadvantages on the side of enforcement (consid. 1).

Titelzeile

BVerfGE 104, 23 <27>; 117, 126 <135>; 121, 1 <17>; stRspr).

2 Diese Entscheidung ist unanfechtbar.

Kernrechtsfrage

Whether an interim order should be issued to suspend the entry into force of the data retention provisions.

Extrahierter Entscheid

The application was refused because the applicant did not show that the disadvantages of allowing the law to enter into force and later finding it unconstitutional would clearly outweigh the disadvantages of temporarily blocking a law that might prove constitutional.

Extrahierte Begründung

Under § 32(1) BVerfGG, the Court weighs the consequences. That balance did not favor provisional suspension, so the exceptional remedy was not justified.
