Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Der Wert des Gegenstands der anwaltlichen Tätigkeit in dem Verfassungsbeschwerdeverfahren wird auf 5.000 € (in Worten: fünftausend Euro) festgesetzt.

Gründe

1 1. Der Verfassungsbeschwerde kommt weder eine grundsätzliche Bedeutung zu noch ist ihre Annahme zur Durchsetzung von in § 90 Abs. 1 BVerfGG genannten Rechten der Beschwerdeführerin angezeigt (§ 93a Abs. 2 BVerfGG).

2 Das Landesarbeitsgericht ist zwar in verfassungsrechtlich nicht hinreichend begründeter Weise davon ausgegangen, dass es sich bei den Äußerungen der Beschwerdeführerin ausnahmslos um Formalbeleidigungen und Schmähkritik handelt. Insbesondere fehlt die verfassungsrechtlich gebotene Abwägung der Meinungsfreiheit der Beschwerdeführerin und der persönlichen Ehre der von den Äußerungen Betroffenen sowie der wirtschaftlichen Betätigungsfreiheit der Beklagten des Ausgangsverfahrens. Die Verfassungsbeschwerde ist aber dennoch nicht zur Entscheidung anzunehmen, da kein besonders schwerer Nachteil im Sinne von § 93a Abs. 2 Buchstabe b BVerfGG vorliegt. Es ist deutlich abzusehen, dass die Beschwerdeführerin auch im Falle der Zurückverweisung an das Ausgangsgericht im Ergebnis keinen Erfolg haben würde (vgl. BVerfGE 90, 22 <25 f.>), da aufgrund der konkreten Umstände davon auszugehen ist, dass auch bei Vornahme der verfassungsrechtlich gebotenen Abwägung die Meinungsfreiheit hinter den Belangen der Beklagten des Ausgangsverfahrens zurücktreten würde.

3 2. Die Festsetzung des Gegenstandswerts beruht auf § 37 Abs. 2 Satz 2 in Verbindung mit § 14 Abs. 1 RVG (vgl. BVerfGE 79, 365 <366 ff.>).

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Diese Entscheidung ist unanfechtbar.
