Omnilex-Zusammenfassung

The Federal Constitutional Court did not accept the constitutional complaint for decision. It held that the complainant had not substantiated the complaint as required by §§ 23(1) sentence 2 and 92 BVerfGG, because the submission attacked only the reasoning of the Administrative Court and failed to address the independent and partially further developed reasoning of the Higher Administrative Court. The Court therefore found the complaint inadmissible and dispensed with further reasoning under § 93d(1) sentence 3 BVerfGG.

Omnilex-Regeste

§§ 23 Abs. 1 S. 2, 92 BVerfGG; substantiation of a constitutional complaint against an appellate judgment: The complainant must engage with the decisive reasoning of the challenged decision itself. A submission that addresses only the first-instance reasoning, while leaving unchallenged the appellate court’s own independent or supplementary grounds for confirmation, does not satisfy the requirement of substantiated reasoning and renders the constitutional complaint inadmissible. The Court may refrain from further reasoning under § 93d Abs. 1 S. 3 BVerfGG (consid. 1–2).

Titelzeile

Nichtannahmebeschluss: Substantiierungsmangel (§§ 23 Abs 1 S 2, 92 BVerfGG) bei unzureichender Auseinandersetzung mit argumentativer Begründung des angegriffenen Berufungsurteils

Tenor

Kernrechtsfrage

Whether the constitutional complaint met the substantiation requirements under §§ 23(1) sentence 2 and 92 BVerfGG

Extrahierter Entscheid

The complaint was not sufficiently substantiated because it addressed only the Administrative Court's reasoning and failed to grapple with the Higher Administrative Court's own, partly more detailed reasoning.

Extrahierte Begründung

A constitutional complaint must confront the decisive reasoning of the challenged judgment. Since the Higher Administrative Court had partly accepted the complainant's arguments but ultimately confirmed the first-instance judgment with its own reasoning, the failure to address that reasoning rendered the filing inadmissible.
